After being in the job for thirty years and more, a recent case shows just how important it is to have your farm loan arranged by someone who knows the legal side of things, and who knows how to deal with problems.
During the process of arranging our customers’ agricultural mortgage, we established that there was a restrictive covenant, on the legal title, that needed a third party to sign a certificate that it had been complied with. We knew this because we have our own Land Registry account, so that we are ahead of the lawyers in knowing what issues can arise when arranging farm loans.
We were able to prepare the necessary certificate and explain to all why it was required. We could have left it to the lawyers, which would have been more expensive and taken far longer.
The point is that we want to make a real difference when we arrange farm finance, and we do this by taking a hands on approach. We preempt possible problems and deal with them so that our customers don’t have to.
In the years we’ve arranged loans for land, we’ve often been involved in all kinds of legal issues – we’ve attended court for customers, provided evidence to the court, and dealt with a whole host of legal issues that come up without fuss. It helps to have nous.
Farm finance and land finance can throw up legal issues that need experience and this is never more relevant in today’s world where even getting to speak to someone can be difficult.
